By accessing or using the Reindeers Forever Gifts website and platform (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not use the Service.

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will notify registered users of material changes at least 30 days in advance via email or a notice on the Service.

Reindeers Forever Gifts is a 501(c)(3) tax-exempt nonprofit organization that operates an online platform to connect donors with children in need through gift matching.

Our platform facilitates physical gift donations only. We do not process monetary transactions, payments, or financial transfers of any kind. Donors fulfill wishes by purchasing and shipping items directly to recipients.

To use certain features of the Service, you must create an account. By registering, you agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activity that occurs under your account
• Promptly notify us of any unauthorized use of your account

You must be at least 18 years old to create an account. Accounts are for individual or authorized organizational use only and may not be shared or transferred to another party.

Upon registration, you select a permanent role that determines how you interact with the platform:

Donors

• Browse and fulfill gift requests by purchasing and shipping items
• Offer free items for recipients to claim
• Provide accurate descriptions of donated items
• Follow through on commitments to fulfill wishes

Recipients

• Create honest and accurate gift requests
• Respond to donors and provide updates when gifts are received
• Use the platform for genuine needs only

Care Agencies

• Submit requests on behalf of children and families in their care
• Ensure accuracy of information submitted on behalf of others
• Coordinate gift delivery to intended recipients
• Maintain proper authorization to act on behalf of minors

You agree not to:

• Use the Service for any unlawful purpose or to solicit illegal activity
• Submit false, misleading, or fraudulent gift requests or offers
• Impersonate another person or misrepresent your affiliation with any organization
• Attempt to gain unauthorized access to other accounts or systems
• Use the platform for commercial purposes or personal financial gain
• Harass, abuse, or harm other users
• Upload content that is offensive, harmful, or violates others' rights
• Interfere with or disrupt the Service or its infrastructure

We reserve the right to suspend or terminate accounts that violate these guidelines without prior notice.

Your Content

You retain ownership of content you submit to the Service, including gift requests, images, and descriptions. By posting content, you grant Reindeers Forever Gifts a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content in connection with operating the Service and promoting our nonprofit mission.

Our Content

The Service's design, logos, text, graphics, and software are owned by or licensed to Reindeers Forever Gifts and are protected by copyright and trademark laws. You may not reproduce, modify, or distribute our content without prior written permission.

• Facilitation only: we connect donors with recipients but do not handle, ship, or inspect donated items.
• No guarantees: we cannot guarantee that any wish will be fulfilled or that donated items will meet expectations.
• Tax deductibility: donations of physical goods may be tax-deductible. Please consult your tax advisor for specifics. Reindeers Forever Gifts does not provide tax advice.
• No monetary transactions: the platform does not process payments. All gift fulfillment occurs outside our platform.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability

To the fullest extent permitted by law, Reindeers Forever Gifts, its directors, officers, volunteers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to damages related to donated items, failed deliveries, or interactions with other users.

Indemnification

You agree to indemnify and hold harmless Reindeers Forever Gifts from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination:

• Your right to use the Service ceases immediately
• Active gift requests or offers may be removed
• Data retention follows our Privacy Policy

You may delete your account at any time by contacting us at the email address provided below.

• Governing law: these Terms are governed by the laws of the State of California, without regard to conflict of law principles.
• Dispute resolution: any disputes shall be resolved through good-faith negotiation first. If unresolved, disputes shall be submitted to binding arbitration in California.
• Severability: if any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.
• Entire agreement: these Terms, together with our Privacy Policy, constitute the entire agreement between you and Reindeers Forever Gifts regarding the use of the Service.
